About These Terms

The site and services are provided on an "as is" and "as available" basis without any warranties of any kind. To the maximum extent permitted by law, E-MAILiT Technologies, Ltd, its founder, and team members expressly disclaim all representations and warranties, whether express or implied, oral or written, including any warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, and system integration. E-MAILiT Technologies, Ltd, its founder, and team members make no warranties about the accuracy, reliability, completeness, quality, or timeliness of the site or services, or that problems with the foregoing will be corrected, or that the site is free of harmful components.

The Terms of Service constitute the entire agreement between you and E-MAILiT Technologies, Ltd and govern your use of the service, superseding any prior agreements between you and E-MAILiT Technologies, Ltd. The Terms of Service and the relationship between you and E-MAILiT Technologies, Ltd shall be governed by the laws of the city of London without regard to its conflict of law provisions. You and E-MAILiT Technologies, Ltd agree to submit to the personal and exclusive jurisdiction of the courts located within the city of London. The failure of E-MAILiT Technologies, Ltd to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the service or the Terms of service must be filed within one (1) year after such claim or cause of action arose or be forever barred.

In order to provide certain services, you must allow E-MAILiT Technologies, Ltd to use raw data related to the use and distribution of your content that will be collected as part of the services. You hereby grant E-MAILiT Technologies, Ltd a non-exclusive, perpetual, worldwide and irrevocable right and license to utilize the data to track, extract, compile, synthesize, aggregate, and analyze such data, including, but not limited to, the creation of anonymous and promotional tracking data. We reserve the right to use, reproduce, distribute and display tracking data, in our sole discretion.

Under no circumstances shall E-MAILiT Technologies, Ltd be liable for direct, indirect, incidental, special, consequential or exemplary damages - even if E-MAILiT Technologies, Ltd has been advised of the possibility of such damages - resulting from any aspect of your use of the E-MAILiT Technologies, Ltd site or the service, whether the damages arise from use or misuse of the E-MAILiT Technologies, Ltd site or the service, from inability to use the E-MAILiT Technologies, Ltd site or the service, or the interruption, suspension, modification, alteration, or termination of the E-MAILiT Technologies, Ltd site or the service. Such limitation shall also apply with respect to damages incurred by reason of other services or products received through or advertised in connection with the E-MAILiT Technologies, Ltd site or the service or any links on the E-MAILiT Technologies, Ltd site, as well as by reason of any information or advice received through or advertised in connection with the E-MAILiT Technologies, Ltd site or the service or any links on the E-MAILiT Technologies, Ltd site. These limitations shall apply to the fullest extent permitted by law. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to you.

E-MAILiT Technologies, Ltd provides a platform for publishers to offer their users content sharing capabilities, to deliver advertisements, and to analyze Web site performance. Publishers may have the option to:
Use E-MAILiT Technologies, Ltd without any advertising components.
Use E-MAILiT Technologies, Ltd with third party advertising networks.
Use E-MAILiT Technologies, Ltd in combination with advertisements provided by us and third party advertisements.
Use E-MAILiT Technologies, Ltd with advertisements delivered by us.
We may (but we have no obligation) to offer a program in which we sell and deliver to publisher sites advertisements via E-MAILiT Technologies, Ltd. We may select in our sole discretion the publishers who will participate in such a pilot program. The terms of such advertising program, including any revenue distribution, shall be determined in a separate, written addendum agreed to by us and the applicable publishers. We have no obligation to make the advertising program available to you or any other publisher, and we may discontinue offering any advertising services with E-MAILiT Technologies, Ltd at any time. If you use a third party advertising network, you agree that you are solely responsible to abide by the terms imposed by such advertising service. You understand and agree that we have no liability to you for payments of any advertising fees if you opt not to offer advertising through E-MAILiT Technologies, Ltd or if you use third party advertising services; all rights and obligations are between you and the advertising service.

You agree to indemnify and hold E-MAILiT Technologies, Ltd, its founder, subsidiaries, assigns, service providers, suppliers and team members, harmless from any claim or demand, including attorney fees and court costs, made by any third party due to or arising out of content you submit, post or make available through the service, your use of the service, your violation of the Terms of Service, your breach of any of the representations and warranties herein, or your violation of any rights of another.
